Definition
The offence of dealing in financial instruments while in possession of inside information, or encouraging another person to deal based on inside information. Inside information is precise, non-public information that, if made public, would be likely to have a significant effect on the price of the relevant financial instruments.
Regulatory Context
Insider dealing is both a civil and criminal offence in most jurisdictions. Under MAR, issuers must maintain insider lists and disclose inside information as soon as possible. Firms must have policies and procedures to identify and manage conflicts of interest and information barriers (Chinese walls).
